Formal Administration &
Asset Unfreezing
The standard probate process for estates valued over $75,000. We obtain the “Letters of Administration” you need to unlock bank accounts and transfer real estate.
Start the ProcessDo You Need Formal Administration?
In Florida, Formal Administration is the “standard” form of probate. While it is more involved than Summary Administration, it is necessary for most estates to fully protect the Personal Representative from creditors and to legally transfer assets.
You typically need this service if:
- The estate’s assets are valued at over $75,000.
- The decedent passed away less than 2 years ago.
- A bank or financial institution is demanding “Letters of Administration” to release funds.
- There are potential creditors or disputes among heirs.
The 5-Step Process (How We Help)
1. Filing the Petition
We file the Petition for Administration with the Circuit Court and ask the judge to appoint you as the Personal Representative.
2. Letters of Administration
The court issues the “Letters.” This is your “Golden Ticket.” It gives you the legal authority to walk into a bank and unfreeze the decedent’s accounts.
3. Notice to Creditors
We publish a legal notice to flush out any debts. This starts a 90-day clock for creditors to file claims. If they miss the window, their claims are barred forever.
4. Asset Inventory & Accounting
We help you compile a list of assets and pay valid debts/taxes from the estate funds. We ensure your accounting is audit-proof.
5. Distribution & Discharge
Once the court approves, you distribute the remaining assets to the beneficiaries. We then petition to close the estate and discharge you from liability.
